Acquisitions
We assist our clients in all areas of acquiring and selling residential and commercial real estate. Negotiation, title review, and documentation of the transaction are primary functions of real estate attorneys and we ensure that our clients receive competent and timely assistance regarding these matters. Whether the property is a small condo or a large commercial building with existing tenants, we work closely with our clients to make sure that expectations are met and problems are avoided or minimized.
Financing
Feldman/Wertz handles matters concerning everything from construction loans, permanent loans, oversight of construction administration, to complex housing developments with public and private financing. We have experience with financing construction for resort community homes as well as experience with both public trustee and judicial foreclosures.
Condominium
We assist condominium associations and unit owners in all areas of condominium law including; covenants and restrictions, collection of assessments with condominium liens and foreclosures, declarations for both new developments and condominium conversions and any type of dispute concerning a unit owner or a homeowner’s association.
Leasing and Tenancies
We have a great deal of experience with commercial and residential leasing, representing both landlords and tenants over the past 20 years. We assist with negotiating and drafting leases that focus on clear and purposeful provisions. We strive for simplicity and clarity when it comes to lease provisions. When drafting a lease, we believe both parties must understand their rights and obligations in order to properly appraise the tenancy and ensure that terms are met. With leasing, the success of a tenancy is always the primary objective. Successful tenancy occurs through thoughtful lease preparation to tenant evaluation both from a financial perspective as well as a use perspective. If a dispute arises, Feldman/Wertz has significant experience with leasing disagreements, including eviction proceedings and other related leasing litigation from the small residential tenancy to large hotel and commercial operations.
Negotiating and drafting effective leases can be a crucial part of starting a new business and we work closely with entrepreneurial clients to make sure that their expectations are met, and their interests are protected.
Land Use
Land use matters can vary from simple disputes to complicated issues regarding easements, zoning, right-of-way, planning and development, among others. We are committed to attentive representation that strives to speed up the process and avoid bureaucratic delays.
